These Terms of Use (the "Terms") govern your use of the CERKA mobile app (the "App"), operated by Tech Pro Repairs LLC, organized in the State of Connecticut, United States ("CERKA," "we," "us"). By creating an account or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. The service
CERKA is a tool for discovering creative talent. It lets you search by city and category (Model, Photographer, Makeup Artist, Videographer, Hair Stylist, Content Creator) and contact professionals outside the App via WhatsApp, Instagram or their website.
2. Eligibility and accounts
- You must be 18 or older to use the App and to create a professional profile.
- You sign up with your email address and a password. You must provide accurate information and keep your password confidential. You are responsible for activity on your account.
- One account per person, unless we authorize otherwise.
3. Professional profiles
If you create a professional profile, its content (name, category, city, country, bio, specialties, availability, photos, Instagram, WhatsApp and website) will be public to anyone using the App. You are responsible for keeping it accurate and up to date, and you can edit it at any time.
4. Prohibited content and conduct
You may not post or do any of the following:
- Nudity, sexual content or explicitly sexually suggestive content.
- Profiles, photos or content of anyone under 18.
- Impersonating another person or brand, or providing false information.
- Fraud, scams, spam or misleading payment requests.
- Hate, harassment, threats, violence or discrimination.
- Photos or other content you do not have the necessary rights to (you must be the author or have permission, including from people shown).
- Illegal activity, or attempting to gain unauthorized access to, interfere with, or scrape the App.
5. Your content
You keep ownership of the content you upload. You grant us a non-exclusive, worldwide, royalty-free, limited license to host, store, reproduce, adapt (for example, resize photos) and display that content solely to operate and promote the App. This license ends when you delete the content or your account, except for anything we must keep by law.
6. Reports and moderation
You can report profiles with inappropriate content from within the App. We may review, hide or remove content, and suspend or terminate accounts that, in our reasonable judgment, violate these Terms or put other users at risk, with or without prior notice. We are not obligated to monitor all content.
7. Paid subscriptions: PRO and BOOST
- PRO is a monthly subscription. BOOST is a weekly subscription that ranks your profile first in search results.
- Payments are processed through Stripe. CERKA does not store card numbers; Stripe processes your payment information under its own privacy policy.
- Auto-renewal: subscriptions renew automatically at the end of each period (monthly or weekly) at the then-current price shown at purchase, until you cancel.
- Cancellation: you can cancel at any time by emailing contacto@getcerka.com or through Stripe's subscription management tools, when available. Canceling stops future charges; your subscription stays active until the end of the period already paid.
- Deleting your account cancels any active subscriptions.
- Refunds: we do not offer refunds for partial or unused periods, except where required by applicable law.
- BOOST improves a profile's ranking but does not guarantee contacts, bookings or results. We may change prices or features with reasonable prior notice; price changes take effect at the next renewal.
8. Account deletion
You can delete your account in the App. This deletes your profile, photos and login data and cancels your subscriptions. Some records (for example, Stripe payment records) may be retained where required by law, as described in the Privacy Policy.
9. Third-party services and links
Contact via WhatsApp, Instagram or websites happens outside CERKA and is governed by those services' terms. We do not control and are not responsible for them.
10. No warranties
The App is provided "as is" and "as available." We do not verify the identity, experience, quality, licenses or conduct of professionals or users, and we do not guarantee that profiles are accurate or that the App will be uninterrupted or error-free. Use caution when contacting or meeting other people.
11. Limitation of liability
To the fullest extent permitted by law, CERKA and Tech Pro Repairs LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities, or for the acts, services, content or agreements of users and professionals. Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so they may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Tech Pro Repairs LLC from claims arising out of your content, your use of the App, your agreements with other users, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the competent courts of that State, unless the law where you live gives you rights that cannot be waived.
14. Changes and general terms
We may modify these Terms; we will post the new version with its date and, for material changes, give you reasonable notice. Continuing to use the App means you accept them. If any provision is invalid, the rest remains in effect. Not enforcing a right is not a waiver of it.
